PRIVACY POLICY

This document concerns the Privacy Policy (hereinafter referred to as the
"Policy") implemented by Équipements EMU (hereinafter referred to as "EMU"), owner and
manager of the (current and future) "emu.ca" sites and/or, as the case may be, any other sites replacing or adding to them (hereinafter referred to as the "Site(s)"), in order to ensure the preservation of the confidentiality of personal and/or confidential information and the respect of your privacy.

What is meant by "personal information"?

“Personal Information” is information about a natural person that can be used to identify them. For example, personal information may include your name, contact information (mailing address and home telephone number, email address), date of birth, credit card information, and your access code to the sites.

This Policy applies to the actions taken by EMU with respect to the personal or sensitive information (hereinafter collectively referred to as the “Information”) of individuals and/or, depending on the context, businesses (hereinafter referred to as the “Customers” or “you”) who have registered with EMU, either online or by any other means made available to them for this purpose, in order to benefit from the various services offered by EMU or who have purchased products offered by EMU from its online store.

1) COLLECTION OF INFORMATION

EMU only collects Personal Information to the extent necessary to
fulfil its mission.
More specifically, EMU collects Information in the following situations:
a) Subscription to electronic communications in order to receive timely information
on products, promotions, training offered as well as on activities organized by
EMU (emu.ca);

b) Purchase of training and other EMU products at the online store (emu.ca);

2) USE OF INFORMATION

a) As part of the management of the services offered
The Information collected is used in particular to identify you; to communicate
with you; to determine your eligibility for training; to establish the results
obtained in the context of training; to determine the right to obtain
professional recognition; to confirm online purchases of the various products
and services of EMU; to manage online payments and,
generally, to enable the administration of the training platform and the various
products and services offered by EMU, as well as to obtain information to
improve them, including through satisfaction surveys.
In certain cases, and given the nature of the services provided by
EMU, particularly in the context of the certification program, EMU
may communicate your relevant Personal Information to any person,
institution, company or responsible body – including the Ministry of Labor,
Employment and Social Solidarity – having a recognized need to access it and being
subject to an obligation to maintain confidentiality and respect privacy.

b) As part of services offered by external providers
It may happen that EMU uses external service providers
to offer a service in certain specific areas. In such a case, some of the
Customer Information may be transmitted to these providers. These
suppliers are contractually bound to this policy and must use the
Information provided only in connection with services intended for
EMU.

If, however, these external suppliers wish to obtain additional
information directly from you (for example, in order to analyze the use of their
services), you will be notified in advance. If you agree to provide this
information, the external provider's privacy policy
would then apply to this communication.

c) In the context of a legal obligation
EMU may have to disclose its Customer Information to
competent persons or authorities if this proves necessary in order to comply with
legal obligations, to obey a court order, to protect and
defend its rights or to enforce the terms of use of its services.

d) In exceptional situations
In the event that we wish to use or disclose Information of our
Customers for purposes other than those specifically described in this Policy,
we undertake to obtain their consent.

Depending on the nature of the information, this consent may be provided orally,
by means of a form, a message or written correspondence or, in certain
cases, implicitly, if this consent can be clearly inferred from the actions taken
by the Client.

3) PROTECTION OF INFORMATION

Regarding the protection of personal information collected or communicated
in the performance of its mandate, EMU complies in particular with the Act respecting the
Personal Information Protection and Electronic Documents Act of Canada
and the Act respecting the protection of personal information in the private sector
of Quebec. In addition, under its framework agreement on the sectoral development of
la workforce and employment with the Minister of Labour, Employment and Social Solidarity
, EMU has committed to complying with the obligations set out in the Act respecting
access to documents held by public bodies and the protection of personal information
(R.S.Q., c. A-2.1). To this end, EMU uses various measures
to ensure the integrity and confidentiality of its
Customers' Personal Information. These measures are intended to prevent the loss or theft of such information, as well as
unauthorized reproduction, modification, use, consultation and/or disclosure.
Industry-recognized technologies are used to secure the
Sites. Only authorized personnel may have access to our Customer Information,
and only for the purposes stated herein or required by the services offered.
Agreements are also signed between EMU and its employees and subcontractors so that all of our customer information is used in a manner
compliant with this Policy and all applicable laws, rules and regulations.

4) SECURE ONLINE PAYMENT

The management of any online payment on one of our Sites has been entrusted to a
recognized secure payment provider. Transaction data (
invoice details, customer ID, credit card number) is encrypted from the
Site, in order to be transmitted to the transaction processing system.
The confidentiality of your Information is
thus preserved. Except for the exceptional situations provided for herein,
EMU and the processing system undertake never to disclose information
concerning your credit card.

5) USE OF COOKIES OR OTHER TRACKING TECHNOLOGY

A cookie (hereinafter referred to as "Cookie") is a small text file that contains a unique identification number
that is transferred from a site to your computer's hard drive. A
Cookie allows us to uniquely identify users of a site and track certain
of their activities on this site.

Cookies are used to better understand the traffic on our Sites and to
improve their quality. The anonymity of Internet users who visit our Sites is preserved
at all times.

We also insert a unique electronic image into the source code of
each of the emails sent in bulk. This image uses technology that
transmits certain information to EMU that allows us to know
if the recipient's email address is valid, if this email was received, if it was opened and
if the recipient clicked on a link in the email.

This information is collected to ensure the effectiveness of mailings and to allow us
to gather statistics about the use of our services.

6) HOW LONG IS THE INFORMATION RETAINED?

EMU will not use your Information only for the period essential
to the uses provided for herein. Furthermore, EMU undertakes to
delete or destroy all Personal Information from your account if you
make a written request, sent by email or by post, to the address indicated below.
The information recorded in your training records will however be retained
for as long as necessary, in order to ensure that our records, as well as the
information relevant to your participation in these training courses, are complete and
accessible, in accordance with recognized commercial practices and with
any applicable regulatory requirements, as the case may be.

7) CUSTOMER OBLIGATIONS

The Customer is obliged to ensure that any access code issued to him by
EMU and any password used in connection with the services offered are kept secret.

8) VERIFICATION OF THE ACCURACY OF INFORMATION

We make every effort to ensure that the information in your
file remains accurate, complete and up-to-date. It is therefore important to
notify us of any relevant changes in the information concerning you that
has been provided to us. In order to verify the accuracy of the information about you
and/or to ask us to correct any inaccurate information, if applicable
you are authorized to consult your file, including the Personal Information
collected, by contacting EMU in writing, either by email or
by mail, at the address indicated below.
We may also contact you by email or telephone in the event
of an inaccurate sender address or any other information that appears to us
to be inaccurate.

9) MODIFICATION OF THIS POLICY

This Policy may be updated from time to time. EMU reserves
the right to modify this Policy at its discretion, including by adding or
deleting certain elements or terms.

To help you identify changes to the Policy, these modification dates
will be prominently displayed on our Sites, in a space reserved for this purpose.
